Davidenko: Mobilized Soldier Failed to Return to His Unit After Medical Treatment

About the case: Igor Arturovich Davidenko, a mobilized soldier, is charged with leaving his military unit without authorization during an armed conflict (Part 5 of Article 337 of the Criminal Code of the Russian Federation).

The case is being heard by the Novocherkassk garrison military court, with Judge Mikhail Borisovich Kozhevnikov presiding.

Present are the defendant, Davidenko (who is under a written undertaking not to leave), his lawyer, the prosecutor, and a representative of the military unit.

The court questions Davidenko. The judge speaks very quickly, and not everything can be made out.

He was wounded and granted leave for medical treatment until January 12, 2024, but did not report to his military unit on that date. He returned to the unit on January 29, 2024. He fully admits his guilt. At the time of the offense he was not receiving inpatient treatment; he could not get in touch with the unit because he could not find its contact details.

He has 2 children under the age of 14 as dependents.

He has not tried to make amends for the harm caused, has not made any donations, and has not written any letters of apology.

The judge specifically asks whether he has relatives abroad; Davidenko has none.

After he was located, he was not sent to the “special military operation zone”. He wishes to continue serving, but not in the “special military operation zone”. He is serving under mobilization.

The certificate confirming his injury has not been added to the case file; it is at the defendant’s home. The hearing is adjourned so that it can be submitted.
